Apex Access · coming soon
# Turn accessibility into work you can sell.

Scan a client site against WCAG 2.1 AA and get back something you can put in front of a client: what fails, who it shuts out, where it is, and what to fix first. In your agency’s name.

 Why clients are asking
## The bill for an inaccessible site now arrives by post.

ADA lawsuits in 2025 8,667 Filed in US federal court under Title III. 2026 is running ahead of it.

Are about a website 1 in 3 Roughly a third of those filings name a digital barrier.

Minimum, per violation $4,000 California’s Unruh Act, plus legal fees. It applies wherever the business is based.

 What it checks
## The failures that actually shut people out.

Every finding is tied to the WCAG 2.1 AA criterion it breaks, written so a client can understand it and a developer can fix it.

### Contrast and text

Text that disappears against a photo or a brand colour, and text that cannot be resized.

### Images and media

Missing alt text, decorative images announced needlessly, video without captions.

### Keyboard and focus

Anything you cannot reach without a mouse, and themes that hide the focus outline.

### Forms and errors

Fields with no label, errors announced only in colour, checkouts that trap a screen reader.

### Structure and landmarks

Heading levels that skip, missing page language, and ARIA that makes things worse.

### What needs a human

The checks no tool can judge are listed as a short manual pass, with steps. We would rather tell you than pretend.

 White-label report
## Your audit, not a tool’s export.

Issues are grouped by how much they matter, not dumped as a list of rule codes. Every one says who it affects and what it breaks, so the report works as a proposal: here is the problem, here is the fix, here is the quote.

- Your logo, colours and contact details
- Severity in plain language, not rule jargon
- Re-scan after the fixes to show the progress

 Where it bites
## Three deadlines your clients already have.

Not legal advice, but this is what agencies are being asked about.

### US: private business

Title III of the ADA is enforced by private lawsuits, and website claims are a large and growing share of them. There is no grace period; the obligation exists now.

### California

The Unruh Act adds statutory damages from $4,000 per violation, plus legal fees, and it reaches any business serving California customers. California sees the most filings of any state.

### EU: the Accessibility Act

In force since June 2025 for online shops and services, including companies outside the EU that sell to EU customers. Enforcement and the first cases have already started.

 Questions
## Early answers

Does this make a site compliant?

No tool can. Automated tests catch the machine-checkable failures, which is a large share of what is wrong on a typical site but not all of it. Apex Access tells you which checks still need a person, and how to do them, rather than handing you a green tick you cannot rely on.

Is this one of those accessibility overlay widgets?

No, and it never will be. Overlays sit on top of a site and claim to fix it at run time; they are widely criticised by disabled users, and they have not stopped lawsuits. Apex Access finds the problems so you fix them in the code.

Which standard do you test against?

WCAG 2.1 Level AA, which is what US rules for public bodies and the EU Accessibility Act both point at, and what courts and procurement teams treat as the bar.

Can I sell audits with this?

That is the point. The report carries your branding, and it is written to hand straight to a client as the basis for the remediation work.

Will it work with Apex Proof?

That is the plan: audit a site with Access, then track the fixes with Proof, where a reviewer can point at the element on the page.

When is it coming, and what will it cost?

Apex Access is next on the roadmap. It will be included in the Apex founding membership: $30/mo for every Apex tool. [See the details](https://apex.mountainairweb.com/proof#pricing).
